NEW CODE OF PRACTICE ON DISMISSAL AND RE-ENGAGEMENT

A new Code of Practice on Dismissal and Re-engagement will come info effect on 18 July 2024 setting out the Employer’s responsibilities when seeking to change employment terms.

The purpose of the Code is to ensure that all reasonable steps are taken by the Employer  to  explore alternatives to dismissal and engage in meaningful consultation with a view to reaching agreement with employees.

The provisions of the Code aim to ensure as much information as possible is provided to employees and that consultations continue in good faith for as long as reasonably possible to try and reach an agreed outcome. 

Dismissal and re-engagement should be a last resort and ACAS should be contacted before raising this prospect.

The Code will apply regardless of the number of employees affected (but will not apply in a genuine redundancy situation).
